Wellington 1880
John Prosser (1890 - 1925)

John now aged 50 years has packed more action in his life than most, but still the momentum of his life does not slow. He appears a juggler - balls in the air and moving with the play of life! However his skill falters - he stumbles a little, then has health problems, recovers and his faithful wife Jane accompanies him on this, his last chase. He found after a period of farming when he returned to Wellington in 1888 that, no longer was it the mecca for coach travel, but, not daunted, he endeavours to find locations that combine his love of hostelry with the demands of offering transport routes onwards.

1896 20 Oct: Bankruptcy of John Prosser. Mr Trimble sat as registrar of the Bankruptcy Court this (Friday) morning to hear an application on behalf of D.O.A. in tbe estate of John Prosser, of Stratford, to declare fraudulent and void as against the assignee certain transactions and deeds given by tbe bankrupt in favor of one Ofsofeki. These made 28th September last purported to transfer Prosser's interest in tbe Empire Hotel stock, and a section of railway reserve, the consideration being £847, a part debt due by Prosser to Ofsofski, a payment of £100, and the taking over of mortgage by N.  Johnston, of Hawera.

Mr Caplen, who said he had just been instructed, applied for an adjournment of the case, for he knew nothing of the character of tbe motion until he came into court.

Mr Welsh objected to any adjournment, because due notice had been given and it was tbe parties own fault if that had not instructed counsel, But he had been informed that they had instructed counsel at Stratford and tbat counsel had said he would apply for an adjournment. The assignee believed that Ofsofssi was illegally in possession of the hotel and. premises and was wasting, the creditors' property, and, therefore, it was urgent. Tbe Registrar said tbat counsel in Stratford had informed him that he was instructed.

Mr Caplen said that Ofsofski would swear that he had not instructed counsel to appear for him. There might have been instructions from Prosser. After discussion, The Registrar said he did not see his way to grant an adjournment. Mr Caplen retired. The application was then proceeded with, and Mr Welsh argued that in law the arrangement, which had been made in September within a month of banktruptcy, was void, but he proposed to call evidence to show that the transaction was obviously one that could not stand.

Frank Ofsofeki, son-io-law of Prosser, was sworn and was questioned as to the transaction. It appeared that the £84? was lent in various sums paid by cash, but no receipts or records were produced, and in giving the evidence witness departed materially from statements made on oatb before the Assignee on 10th October, as to how the amount was made up. Witness swore that he did not know of Prosser’s financial position when the deeds were made, and he had bought the hotel on his own offer and notion knowing nothing of the state of the business, though he had heard that nothing was being done by the hotel. Since he had taken over the hotel he had not taken 10s a day; he had spent much more than he had received. In the summer-time he expected to take from £80 to £100 a week. So far he had actually paid in cash £20, and balance of £80 was to be paid when license was granted over to him. Mr Prosser was in error in swearing to the D.O.A that £100 had been paid to him. John Prosser was also called and examined as to transactions between debtor and Ofsofski.

Mr Badge, Deputy Offioial Assignee, produced sworn statements given before him by the two previous witnesses, and said that although it had been sworn thatl £100 was paid in cash he had not been able to find any trace of it. The Registrar made an order declaring tbe deeds void as paid, but refused an application calling for a statement of accounts since the date of the transaction* Costs, £8 3s, and disbursements were allowed.

1893 H&NS; 27 October 1893: DISTRICT COURT. Wednesday, October 25th. (Before Mr District Judge Kettle.) BANKRUPTCY OF JOHN PROSSER, OF STRATFORD, PUBLICAN. The appeal went to tbe Supreme Court.

Frank Ofsofke. son-in-law of bankrupt, stated that he lent bankrupt £347 of his own money. The bankrupt still owes him the money, but he would give up all his claim against Mr Prosser and the estate for the money he lent him.

In answer to Mr Welsh, Mr Scott-Smith said he had received £5 from Ofsofeke (bankrupt's brother-in-law). His Honor said he could not allow more than the £10 allowed by the scale. A long discussion ensued, Mr Scott-Smith submitting that His Honor could use his discretion in granting costs for services outside the ordinary bankruptcy business.
