station, on 27th inst. August 1895 at Creek Station, Geraldine, the
wife of B. P. Bartrum, of a son.
Corporal Cyril Frederick
Bartrum was killed in action in France on 5 April, 1918. He
was youngest son of late Mr B.P.Bartrum of Fairlie. He was
educated at Waitaki High School and was farming in the North
island aged 23 at the time of his death.

Bartrum reported wounded in the recent offensive, was educated at
the Waitaki Boys' High School, and liter followed farming pursuits,
joining the Rifle Brigade from Wanganui early in 1915. He was an
excellent swimmer, and 20 years of age. His brother, Mr. J. A.
Bartrum is, lecturer on geology at the Auckland University,
and his parents havo for some years resided in Fairlie, South
Canterbury;

November 1921 INTERPRETATION OF WILL. QUESTION OF SON'S STATUS. SUPREME COURT JUDGMENT Reservcd
judgment was delivered yesterday by Mr, Justice Herdman in the case
in which J. A. Bartrum and 0. B. Bartrum were plaintiffs, and the
Public Trustee and Marjorie Baker were the defendants, brought under
an originating summons to obtain an interpretation of the will of
Benjamin Packer Bartrum, deceased. A question was raised as to the
rights of Cyril Fredeiick Bartrum, aged 21 years, a son of the
deceased, who was killed during the war in France, to take a vested
interest under the will of his father. His Honor said it seemed to
him to be plain that when Mr. Bartnum declared that a child should
not be entitled to the capital until he or she attained the age of
25 years, he did not mean to make a gift subject to that
contingency; he intended to postpone payment only. The direction to
the trustees to use the income of each child's share for the
advancement, maintenance or benefit of the child until the age of 25
years should be reached supported this view, and it should be noted
that all the income of each share was given for that purpose.
Therefore Cyril Bartrum was within his rights in taking a
vested interest under the will of his father, and Miss Baker, to
whom he left the whole of his property, was entitled to it,
including a one-seventh undivided share or portion of his father's
estate.
